I. SPONSOR
The "Chilean Avocado Lover's Club" drawing (the “Drawing”) is sponsored by The Chilean Avocado Importers Association (CAIA) (hereafter referred to as “Sponsor”). Sponsor can be contacted at: Chilean Avocado Lovers Club, 717 D Street, N.W. Third Floor, Washington, D.C. 20004
II. ELIGIBILITY
The Drawing is open only to legal residents of the Continental United States or the District of Columbia, age 18 and older at time of entry. Entrants must have a valid email address and telephone number to enter. Employees, directors, contractors and officers of Sponsor, AugustineIdeas, Promotion Fulfillment Center, their respective parents, affiliates, subsidiaries, distributors, advertising and promotional agencies or other companies associated with the promotion of the Drawing, as well as the immediate family (spouse, parents, siblings, children, and their respective spouses) and household members of each such employee are not eligible. Void in Alaska, Hawaii, Puerto Rico and where otherwise prohibited by law.
III. AGREEMENT TO OFFICIAL RULES
Participation in the drawings constitutes an Entrant’s full name and unconditional agreement to and acceptance of these Official Rules and the decisions of the Sponsor, which are final and binding. Winning a prize is contingent upon fulfilling all requirements set forth herein.
IV. ENTRY PERIOD
The drawing begins on September 1, 2011 at 12:00:01 a.m. EST and ends on February 25, 2012 at 11:59:59 p.m. EST (the “Entry Period”). Entries that are submitted before or after the Entry Period will be disqualified. Entries will be accepted online ONLY. No other method of entry will be accepted.
V. HOW TO ENTER
ONLINE ENTRY: Entrants can submit an Entry by visiting the Drawing Website at www.chileanavocadoloversclub.com during the Entry Period, completing and submitting the online entry form for one (1) entry into the Drawing (“Online Entry”). All required fields must be completetly filled out to be eligible. Online Entries must be received no later than 11:59:59 p.m. EST on February 25, 2012. Sponsor’s computer is the official timekeeper for this Drawing.
Sponsor reserves the right to determine the suitability of any Entry and/or remove any entry from the Drawing due to inability to follow requirements as stated above. Any Entry deemed inappropriate or unsuitable for posting in Sponsor’s sole discretion will be disqualified.
Limit one (1) Entry per person or/household/email address for the entire Entry Period. Entrants may not enter with multiple email addresses nor may entrants use any other device or artifice to enter multiple times or as multiple entrants. Any entrant who attempts to enter with multiple email addresses under multiple identities or uses any device or artifice to enter multiple times will be disqualified and forfeits any and all prizes won, at Sponsor's sole discretion. All Entries remain the property of Sponsor and will not be returned or acknowledged. Sponsor is not responsible for any technical problems, malfunctions of any telephone service, computer systems, servers, providers, hardware/software, lost or unavailable network connections or failed, incomplete, garbled or delayed computer transmission that may affect the ability of consumers to participate, or for any damage to any participant’s computer system/software related to or resulting from participation in this Drawing. CAUTION: ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE CONTENT OR LEGITIMATE OPERATION OF THIS DRAWINGS IS A VIOLATION OF CRIMINAL AND CIVIL LAW AND, SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR WILL DISQUALIFY ANY SUCH ENTRANT, AND SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES (INCLUDING ATTORNEYS’ FEES) AND OTHER REMEDIES FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW. Proof of submission of an entry will not be deemed to be proof of receipt by Sponsor. Sponsor is not responsible for any typographical, technical, or other error in the Drawing, administration of the Drawing or in the announcement of the prize winners. In the event of a printing/production/typographical error, or equipment error, neither Sponsor, its parent companies, retailers, affiliates, subsidiaries, advertising and promotion agencies, or their respective agents or agencies shall have any liability. In no event will more than the number of prizes stated in these Official Rules be awarded. If entrant fails to provide any information in his or her entry form, entrant’s entry may be disqualified, at Sponsor’s sole discretion. Should multiple users of the same e-mail account enter the Drawing and a dispute thereafter arise regarding the identity of the entrant, the authorized account holder of said e-mail account at the time of entry will be considered the entrant. “Authorized account holder” is defined as the natural person who is assigned an e-mail address by an Internet access provider, on-line service provider or other organization which is responsible for assigning e-mail addresses or the domain associated with the submitted e-mail address. Potential winner may be required to provide Sponsor with proof that he/she is the Authorized account holder of the email account associated with the winning entry.
VI. HOW AND WHEN WINNERS WILL BE SELECTED AND NOTIFIED
There will be four Drawings with separate prizes on or about the Drawing Dates specified below. For each Drawing, the specified number of winners for that Drawing will be selecteded by random from among all eligible entries received by 11:59:59 p.m. EST on the day prior to the Drawing Date indicated in the table below. Non-winning entries will be rolled over into all subsequent Drawings. Odds of winning depend on the number of eligible entries received prior to the Drawing Date. Each winner will be eligible to receive the prize corresponding to that Drawing, subject to verification.

Drawings will be conducted by Sponsor’s agent, an independent judging agency whose decisions on all matters relating to the drawings are final. Winners will be notified by phone, email or mail within five (5) days following the drawing date. Sponsor is not responsible for any change in entrants’ mailing address, email address, and/or telephone number.
VII. REQUIREMENTS OF A POTENTIAL WINNER
If potential winner cannot be contacted by telephone, email or phone within three (3) days after the first attempt to contact him/her, Sponsor may disqualify and select an alternate potential winner in his/her place from the remaining eligible entries. Eligibility, age and all claims made by prizewinners are subject to verification. The Grand Prize winner of the trip to the 2012 Tostitoes® Fiesta Bowl Football Game, scheduled for January 2nd, 2012 in Glendale, Arizona will be required to execute an Affidavit of Eligibility, a Liability Release (where legally permissible) and a Publicity Release. The Affidavit must be returned within the time indicated on the documents. If any potential prizewinner fails to return such documents within the prescribed time, or if a potential prizewinner is found to be ineligible, or If he/she does not comply with these Official Rules, then the potential prizewinner may be disqualified and an alternate prizewinner may be selected from the remaining eligible entries received during the Drawing Period, in Sponsor’s sole discretion. Prizes are not transferable and may not be redeemed for cash. No prize substitutions are allowed. All federal, state, and local taxes are sole responsibility of prizewinners. Grand Prize winner will be issued a 1099 IRS tax form for the ARV of the awarded prize.
VIII. PRIZES
There are twenty seven (27) Prizes. The winner of the drawing on or about November 15, 2011 will win the “Trip Prize” which consists of the following items, (i) roundtrip coach airfare for two (2) people from a major commercial airport near the Grand Prize winner’s residence to Glendale, Arizona; (ii) admission for two (2) to the 2012 Tostitos® Fiesta Bowl Football Game, which will be held on 01/02/2012; (iii) one (1) standard hotel accommodation (based upon double occupancy) for two (2) nights stay; and ground transportation from airport/hotel and hotel/game . The approximate retail value (“ARV”) for this Grand Prize is (ARV $5,100). The actual Grand Prize value may vary depending on the location of the potential Grand Prize Winner’s residence and date of departure. Any difference between stated approximate retail value and actual value of Prize will not be awarded. Seat location of event tickets is in Sponsor’s sole discretion. Tickets are subject to the terms and conditions listed thereon. Sponsor is not responsible if the Tostitos® Fiesta Bowl Game or any portion thereof is cancelled or delayed for any reason, in which event that portion of the prize will be forfeited in its entirety and no substitution will be provided except in Sponsor's sole discretion. The potential Grand Prize winner is responsible for all other trip expenses not specified herein as being awarded, including without limitation any ground transportation other than what is listed above, meals, taxes, luggage fees, incidental hotel charges and gratuities. Potential Grand Prize winner and guest must travel together on the same itinerary. Travel must be taken so as to attend the game on 01/02/2012, as specified by Sponsor, and is subject to certain travel conditions. Travel must be taken on dates specified or prize will be forfeited. Exact travel dates and arrangements subject to availability. Hotel accommodations and air transportation solely based upon availability and will be selected by Sponsor in its discretion. Travel arrangements must be made through Sponsor’s agent, on a carrier of Sponsor’s choice. If winner is eligible, but a minor in his/her state of residence, the travel guest must be winner’s parent or legal guardian. Guest of potential Grand Prize winner must be at least the age of majority in guest’s state of residence. Minors must be accompanied at all times during trip (including, but not limited to, in-flight, hotel stay and all prize-related events) by minor’s parent or legal guardian. Travel guests must sign and return a travel release before any ticketing of travel occurs. Winner and guest are solely responsible for all necessary identification and/or travel documents (e.g., a valid U.S. driver’s license) required for travel. Once travel guests are selected, they may not be substituted, except in Sponsor's sole and absolute discretion. Airline tickets are non-refundable/non-transferable and are not valid for upgrades and/or frequent flyer miles. All airline tickets are subject to flight variation, work stoppages, and schedule or route changes. If in the judgment of Sponsor, air travel is not required due to winner's proximity to Glendale, Arizona, ground transportation will be substituted for roundtrip air travel at Sponsor's sole and absolute discretion. The difference in value will not be awarded to the winner. Sponsor shall not be responsible for any cancellations, delays, diversions or substitution or any act or omissions whatsoever by the air carriers, hotels, venue operators, transportation companies, prize providers or any other persons providing any Prize-related services or accommodations. Additional prize award details and travel information to be provided to the Prize winner at the time of notification. Prize winner and guest are also responsible for obtaining travel insurance (and all other forms of insurance) at their option and hereby acknowledge that Sponsor has not and will not obtain or provide travel insurance or any other form of insurance. Lost, stolen or damaged airline tickets, travel vouchers or certificates will not be replaced or exchanged. The prize must be accepted as awarded without substitution and is not transferable or redeemable for cash. The Sponsor reserves the right in the event that a prize or any component of a prize cannot be awarded as described for any reason, to substitute another prize or component of a prize of equal or greater value, without liability. The winners may be required to provide Sponsor with a valid social security number or tax identification number before the prize will be awarded for tax reporting purposes.
The other twenty six (26) Prize winners will be awarded a prize of one (1) $500 Grocery Gift Card for the grocery store designated on the Winner’s entry form. (ARV $500.00). Gift card subject to terms, conditions and restrictions as stated thereon.
Total ARV of all prizes: ($18,100) Some restrictions may apply. In the event a prize is unavailable, Sponsor reserves the right in their sole discretion to substitute prizes for optional prizes of equal or greater value. Federal, state and local taxes, if any, are the sole responsibility of the winner. Unclaimed prize will be not be awarded.
IX. RELEASE AND LIMITATION OF LIABILITY
By participating in the drawing, Entrants (or their parent or legal guardian if entrant is an eligible minor) agree that Sponsor, AugustineIdeas, Promotion Fullfilment Center, and their respective parent, subsidiary, affiliated and successor companies, advertising and promotion agencies and donation suppliers, and each of their respective officers, directors, agents, representatives and employees, as well as each of their respective successors, representatives and assigns (collectively, the “Released Parties”) are not responsible for and agree to to release and hold harmless the Release Parties from and against any and all actions, claims, injury, liability, loss or damage arising in any manner, directly or indirectly, from participation in the drawing or the receipt or use of any prize, including, but not limited to:
- (a) Any technical errors that may prevent an Entrant from submitting an entry, including any computer system, phone line, hardware, software or program malfunctions, or other errors, failures or delays in computer transmissions or network connections that are human or technical in nature;
- (b) Unauthorized human intervention in the drawing;
- (c) Printing or typographical errors;
- (d) Errors in the administration of the drawing or the processing of entries, including incorrect or inaccurate entry information whether caused by Internet users or by any of the equipment or programming associated with or utilized in the Drawing or by any technical or human error which may occur in the processing of the entries; or
- (e) Injury, death, or damage to person or property which may be caused, directly or indirectly, in whole or in part, from Entrant’s participation in the drawing or any prize related activities, awarding, receipt possession, and/or use, or misuse of any prize, including any travel related thereto.
Entrants (or their parent or legal guardian if entrant is an eligible minor) further agree (a) that in any cause of action, the Released Parties’ liability for any claims, judgments or awards will be limited to the actual out of pocket cost of entering and participating in the drawing and in no event shall the Release Parties be liable for attorney’s fees; (b) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages; and (c) all causes of action arising out of or connected with this Drawing, or any prize awarded, shall be resolved individually, without resort to any form of class action.
Winners authorize the Released Parties to use their name, voice, likeness, liographical data, city and state of residence and entry materials in programming or promotional material, worldwide in perpetuity, or on a winner’s list, if applicable, without further compensation, unless prohibited by law. Sponsor is not obligated to use ony of the above-mentioned information or materials, but may do so and may edit such information or materials, at Sponsor’s sole discretion, without further obligation or compensation.
X. DISPUTES
Except where prohibited, Entrant agrees that any and all disputes, claims and causes of action arising out of or connected with, the Drawing or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate state or federal court located in Washington County, in the District of Columbia. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, Entrant’s rights and obligations, or the rights and obligation of Sponsor shall be governed by the laws of the State of District of Columbia, without giving effect to any choice of law or conflict of law rules, (whether of the State of District of Columbia or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of District of Columbia.
XI. MISCELLANEOUS; DRAWING PRIZE RECIPIENT LIST
Sponsor reserves the right, in its sole discretion, to prohibit the participation of an individual or otherwise disqualify any individual who tampers with the entry process, is suspected of engaging in fraud, or otherwise fails to comply with any requirement of participation as stated herein or with any provision in these Official Rules and to cancel, terminate, modify and/or suspend the Drawing in the event of tampering fraud, virus, bugs or other causes beyond the control of Sponsor, including but not limited to acts of God or civil disturbance that render it impractical or impossible to complete or fulfill the Drawing as originally planned or may corrupt the administration, security or proper play of the game. If Sponsor, in its discretion, elects to alter this Drawing as a result a notice will be posted on www.chileanavocadoloversclub.com. In the event of cancellation, Sponsor will randomly award the prizes from among all eligible, non-suspect entries received prior to cancellation.
Winners will be announced throughout the drawing on ChileanAvocadoLoversClub.com beginning as of [date.
