The “Chilean Avocado Lovers Club” drawing (the “Drawing”) is sponsored by The Chilean Avocado Importers Association (CAIA) (hereinafter referred to as “Sponsor”). Sponsor can be contacted at: Chilean Avocado Lovers Club, 7850 White Lane, Suite E Box 122, Bakersfield, CA 93309.

The Drawing is open only to legal residents of the United States, aged 18 and older (“Entrant”). Any person who appears in an Entry (as defined below) by entering online at www.chileanavocadoloversclub.com (the “Drawing Website”) immediately agrees to the Drawing Rules and Regulations in order to participate. Entrants must have a valid email address and telephone number. Employees of Sponsor or other companies associated with the promotion of the Drawing, as well as the immediate family (spouse, parents, siblings, and children) and household members of each such employee are not eligible. The Drawing is governed by the laws of the United States and void where prohibited. All federal, State, and local rules and regulations apply.

Participation in the Drawing constitutes an Entrant’s full and unconditional agreement to and acceptance of these Official Rules and the decisions of Sponsor, which are final and binding. Winning a prize is contingent upon fulfilling all requirements set forth herein.

The Drawing begins on September 1, 2009 at 12:00 a.m. EST and ends on February 15, 2010 at 11:59 p.m. EST (the “Entry Period”). Entries that are submitted before or after the Entry Period will be disqualified. Entries will be accepted online and via direct mail.

Obtain and fill out an entry form at your local supermarket (an “Entry”). Mail-in entries must be sent to: Chilean Avocado Lovers Club, 7850 White Lane, Suite E Box 122, Bakersfield, CA 93309. Entrants can submit the Entry through the Drawing Website (www.chileanavocadoloversclub.com), via the Facebook.com page (Facebook) or via direct mail to enter the drawing.

Sponsor reserves the right to determine the suitability of any Entry and/or remove any Entry from the Drawing due to inability to follow requirements as stated above. Any Entry deemed inappropriate or unsuitable for posting in Sponsor’s sole discretion will be disqualified.

Limit one Entry per Entrant. All Entries remain the property of Sponsor and will not be returned or acknowledged. Sponsor is not responsible for entries that are lost, stolen, late, illegible, incomplete, damaged, mutilated, misdirected, altered, tampered with, or for postage-due.

Sponsor is not liable for unauthorized usage of Entries or postings on other websites by third parties.

If an Entrant were to be chosen a winner, he or she must agree to appear on the Chilean Avocado Lovers Facebook page. Entrants who have a Facebook account can comment the Chilean Avocado Lovers Club page. By visiting and/or commenting on the page on Facebook, Entrant also consents to the Terms of Use of Facebook found at http://www.facebook.com/terms.php Entrants agree to receive e-mail correspondence from Sponsor and Facebook. Inappropriate comments posted may be removed or edited in the sole discretion of Sponsor.

Winners will be selected at random by Sponsor. Sixty grand-prize winners will each receive a gift card in the amount of $250. Winners must agree to appear on Sponsor’s Facebook page. All decisions by Sponsor are final and are made in its sole discretion.

The odds of winning will vary depending upon the number of entries received. Fifteen (15) Entries will be selected for the Grand Prize described below and 200 Entries will be selected for the Runner-up Prizes described below.

Representatives of the potential winners will be notified by telephone or email no later than March 15, 2010. On March 29, 2010 Sponsor will announce the winners of the Drawing on the Drawing Website.

If an Entrant cannot be contacted by telephone within three (3) days after the first attempt to contact him/her, Sponsor may disqualify such Representative’s Entry and select an alternate potential winner in his/her place from the remaining Entries based on original judging criteria. If the Entrant decides not to accept the prize within three (3) days after being notified by Sponsor, Sponsor may disqualify such Entrant’s Entry and select an alternate potential winner in his/her place from the remaining Entries based on original judging criteria. Prizes are not transferable. No prize substitutions are allowed. All taxes are sole responsibility of prizewinners.

Entrant will be required to agree to the drawing rules within five (5) days of being notified in order to receive prize. If the Entrant fails to agree to the drawing rules, the Entrant’s Entry may be disqualified and an alternate Entry may be selected based on original judging criteria. Winner will need to present valid government issued identification to claim prize.

Sixty (60) Entries will be selected for the Grand Prize of $250 per winner.

Two hundred (200) additional Entries will be selected for Runner-up Prizes who shall receive one Chilean Avocado Importers Association/American Youth Soccer Organization (AYSO) Soccer Balls each.

Some restrictions may apply. Sponsor reserves the right to change prizes for optional prizes of equal or greater value.

Federal, state and local taxes, if any, are the sole responsibility of the winner.

Winners are not entitled to exchange or transfer prizes or to obtain cash or other substitutes, but Sponsor in its sole discretion may substitute prizes of equal or greater value.

By participating in the Drawing, Entrants agree to release and hold harmless Sponsor, their parent, subsidiary, affiliated and successor companies, advertising and promotion agencies and donation suppliers, and each of their respective officers, directors, agents, representatives and employees, as well as each of their respective successors, representatives and assigns (collectively, the “Released Parties”) from and against any and all actions, claims, injury, loss or damage arising in any manner, directly or indirectly, from participation in the Drawing or the receipt or use of any prize, including, but not limited to:
(a) any technical errors that may prevent an Entrant from submitting an entry;
(b) unauthorized human intervention in the Drawing:
(c) printing errors:
(d) errors in the administration of the Drawing or the processing of entries; or
(d) injury, death, or damage to person or property which may be caused, directly or indirectly, in whole or in part, from Entrant’s participation in the Drawing or receipt of any prize. Entrant further agrees that in any cause of action, the Released Parties’ liability will be limited to the cost of entering and participating in the Drawing, and in no event shall the Release Parties be liable for attorney’s fees. Entrant waives the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages.

Entrants authorize the Released Parties to use their name, voice, likeness, biographical data, city and state of residence and entry materials in programming or promotional material, worldwide in perpetuity, or on a winner’s list, if applicable, without further compensation unless prohibited by law. Sponsor is not obligated to use any of the above-mentioned information or materials, but may do so and may edit such information or materials, at Sponsor’s sole discretion, without further obligation or compensation.

Except where prohibited, Entrant agrees that any and all disputes, claims and causes of action arising out of, or connected with, the Drawing or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in the State of California. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, Entrant’s rights and obligations, or the rights and obligation of Sponsor shall be governed by the laws of the State of California, without giving effect to any choice of law or conflict of law rules (whether of the State of California or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of California.

Void where prohibited. All federal, state and local laws and regulations apply.

Sponsor reserves the right, in its sole discretion, to disqualify any individual who tampers with the entry process and to cancel, terminate, modify and/or suspend the Drawing in the event of tampering or other circumstances, including but not limited to acts of God or civil disturbance that render it impractical or impossible to complete or fulfill the Drawing as originally planned.

Winners will be announced throughout the drawing on both ChileanAvocadoLoversClub.com and on Facebook.com.
